Our Terms and Conditions
1. Conclusion of the contract
1.1. 1.1. Booking wishes can be communicated personally, by telephone, by e-mail or by fax. By submitting a booking request, the customer (hereinafter referred to as the guest) declares his / her agreement to conclude a lease agreement on the basis of the present conditions. The guest is requested to confirm this in writing before occupying the apartment. The contract is considered concluded and binding once the guest has received the booking confirmation from City-Appartement by mail, e-mail or fax. If the booking cannot be confirmed in writing due to lack of time, a telephone agreement is sufficient for the apartment to be made available.
2. Arrival and departure
2.1. Unless otherwise agreed in writing, the apartment cannot be occupied before 2 pm on the day of arrival. The keys are handed over at the apartment by appointment. Please call us in advance!
2.2. The apartment must be returned by 10 am on the day of departure. If the room is not vacated by this time, City-Appartement is entitled to charge 50% of the full room rate per day. If the room has not been vacated by 3 pm, the whole day rate is chargeable. If the apartment has been booked but is not available for any reason, City-Appartement is obliged to provide an equivalent replacement insofar as is reasonable.
2.3. Reserved rooms must be occupied no later than 6 pm on the day of arrival. If this is not the case, City-Appartement may retain the apartment unless a later arrival time has been agreed in writing or an advance payment has been made. The reservation is also guaranteed if you have given us your credit card details.
3. Services and prices
3.1. The contractually agreed services are listed in the brochure or on the website of Graz-Tourismus and details are provided in the reservation confirmation relating to the booking. The price includes accommodation, electricity, water, heating, bed linen and towels as well as cleaning. Any other prices or services must be expressly requested in writing.
3.2. Towels and bed linen are changed every 2 weeks or by special arrangement.
3.3. For reservations more than 3 months in advance, City-Appartement reserves the right to amend the agreed prices by max. 15%, e.g. in the event of drastic energy increases, etc.
4.1. In general, a deposit of 50% of the total accommodation contract must be paid immediately after the booking is confirmed. This is to be transferred to an account nominated to you. The remaining 50% of the total accommodation contract is to be paid in advance in cash upon handover of the key. Any other form of payment must be agreed in writing. In the event of premature departure, the remaining balance of the unused service will in principle not be refunded, unless the apartment can be allocated to someone else for this period.
4.2. The place of performance for all payment obligations is Graz.
5. Cancellation conditions
5.1. City-Appartement shall act in good faith to allocate the apartment to someone else where possible, to avoid financial losses. Until such time as the apartment is reallocated, the guest must pay for the duration of the contract according to the following amounts:
5.2. Depending on the date on which the cancellation notice is received, the following cancellation rates will be charged by City-Appartement (as a percentage of the total accommodation contract in each case): Up to the 31st day before arrival: free of charge; from the 30th day before arrival: 50%; in case of non-appearance: 100%.
6.1. The guest is liable for all damage caused to the apartment by himself/herself or by other persons for whom he/she is responsible. City-Appartement is obliged to inform the guest in writing of the damage within 7 days of departure and to invoice accordingly.
6.2. If the apartment key supplied to the guest is lost or damaged, the apartment reserves the right to demand the sum of € 70.00.
6.3. Any use of the apartment outside the terms of the agreement shall result in the contractual relationship being terminated without notice.
6.4. If City-Appartement is hindered by force majeure in the performance of its services, it shall not be liable for damages as a result. City-Appartement shall however be obliged to endeavour to purchase alternative services of equivalent value.
6.5. We are liable for:
6.5.1. The accuracy of the performance description
6.5.2. The due performance of the contractually agreed service
6.6.1. If a service is not provided, or is not included in the contract yet is customary, the guest may demand rectification.
6.6.2. The guest is entitled to demand a reduction in the price corresponding to the reduced rate of performance if, following fruitless demands for compensation, services are not provided or are not provided in accordance with the contract. The guest is obliged to do everything he/she reasonably can in the event of faults and minimize damage that may occur; the guest is obliged, in particular, to notify City-Appartement immediately of his/her complaints. If the guest fails to meet these obligations, he/she will not be entitled to make any claims.
7. Special instructions
7.1. Pets are not allowed.
7.2. The guest must ensure that the apartment is adequately ventilated.
7.3. City-Appartement is entitled to demand that the guest adjusts or reduces any undue noise.
7.4. Any breach of moral behaviour by the guest shall entitle City-Appartement to immediate cancellation of the contract and set off its contractual claims for the period of the reservation. Any damage resulting from the use of the apartment must be paid for.
7.5. All information is correct to the best of our knowledge, but without liability for errors.
7.6. Any items left behind will only be returned upon request and subject to charges. City-Appartement will keep items for 2 months, after which time they will be handed over to the local treasury, insofar as they have a visible value.
7.7. No liability is accepted for money or valuables. Safeguarding of the wardrobe, musical instruments and electronic equipment is the responsibility of the guest.
7.8. The apartment must be returned in a clean condition, with floors swept, dishes washed and windows closed.
8.1. Austrian law applies.
8.2. For all disputes arising from this contract and the fulfilment thereof, the competent place of jurisdiction is agreed to be Graz, as far as legally permissible.
8.3. Should any provision of these General Terms and Conditions be invalid, the validity of the other provisions shall not be affected. The invalid provision shall be replaced by a suitable one. Verbal agreements shall only become effective when they have been confirmed in writing by City-Appartement. We reserve the right to make corrections to printing errors or miscalculations.
